Terms & Conditions for How It’s Played Web App Subscription Effective Date: May 31, 2025 By subscribing to the How It’s Played web app ("App"), you agree to these Terms and Conditions ("Terms"). If you do not agree, do not subscribe or use the App. 1. Subscription Details Plans: Yearly subscription for $8.99 USD ("Subscription Fee"). Billing: Charged every 12 months from the purchase date. Monthly subscription for $0.99 USD ("Subscription Fee"). Billing: Charged every 1 month from the purchase date. Auto-Renewal: Subscription renews automatically unless canceled. You will be charged per cycle (yearly or monthly). Currency: All payments are in US dollars (USD). 2. Payment Payment Method: You must provide a valid payment method. You authorize us to charge the Subscription Fee each billing cycle. Failed Payments: If payment fails, we may retry. If unresolved, we may suspend or terminate access. 3. Cancellation Policy: Cancel anytime before the next billing cycle via account settings or by contacting support@how-its-played.com. No Refunds: Fees are non-refundable, except as required by law. Access continues until the cycle ends. Post-Cancellation: No further charges apply after cancellation. 4. Access to the App License: We grant a non-exclusive, non-transferable license for personal, non-commercial use, subject to these Terms. Availability: We aim for constant availability but do not guarantee it due to maintenance or issues. Account: You are responsible for securing your account and its activities. 5. Modifications Price Changes: We may adjust the Subscription Fee for future cycles with 30 days’ notice. You may cancel if you disagree. App Changes: We may update or discontinue features, with notice for significant changes. 6. Termination By You: Cancel as per Section 3. By Us: We may terminate for violating Terms, unauthorized use, or non-payment. Effect: Access ends at the cycle’s end, with no refunds. 7. User Conduct Do not use the App for unlawful or harmful purposes, including malicious code or intellectual property infringement. 8. Intellectual Property The App’s content and features are owned by 'HOW IT'S PLAYED LLC' or licensors, protected by copyright. Do not reproduce without permission. 9. Limitation of Liability To the extent permitted by law, 'HOW IT'S PLAYED LLC' is not liable for indirect damages from App use. Liability is limited to the Subscription Fee paid in the prior 6 months. 10. Governing Law These Terms are governed by Arizona, USA laws. Disputes will be resolved in Arizona courts. 11.
